New Hampshire Firearms Regulatory Overview
New Hampshire adopted permitless carry in 2017 (SB 12). The state imposes no waiting period, no state purchase permits, no assault weapons restrictions, no magazine limits, and no state registration. New Hampshire is among the least regulated states for firearms, placing your compliance obligations squarely on the federal framework.
Background Checks
New Hampshire is a point-of-sale state that uses the FBI's NICS for background checks. The three-business-day default proceed applies. New Hampshire does not issue a concealed carry permit that qualifies as a NICS alternative (since permits are no longer required to carry, the state still issues them for reciprocity but they don't provide NICS exemption). Every sale requires a NICS check.
State Preemption
New Hampshire RSA 159:26 provides state preemption. No city, town, or county may enact ordinances relating to the sale, purchase, ownership, use, possession, transportation, or carrying of firearms that are more restrictive than state law.
Private Transfers
New Hampshire does not require background checks for private transfers. Private sales between residents may be conducted without dealer involvement.
Cross-Border Considerations
New Hampshire borders Massachusetts (very restrictive) and Vermont (very permissive). Be cautious with sales to Massachusetts residents — items legal in New Hampshire may be prohibited in Massachusetts. Long gun sales to non-residents must comply with both New Hampshire law and the buyer's home state law.
