Maine Firearms Regulatory Overview

Maine adopted permitless carry in 2015, becoming one of the earlier states to allow concealed carry without a license. The state imposes no waiting period, no state purchase permits, no assault weapons restrictions, and no magazine capacity limits. Maine's regulatory approach is minimal, placing your compliance focus squarely on federal requirements.

Background Checks

Maine is a NICS direct-contact state. All background checks go through the FBI's NICS. The standard three-business-day default proceed applies. Maine's concealed carry permit does not qualify as a NICS alternative — every buyer undergoes a NICS check regardless of permit status.

Private Transfers

Maine does not require background checks for private party transfers. A 2016 ballot initiative to impose universal background checks was narrowly defeated by voters. Private sales between Maine residents remain unregulated at the state level.

Preemption

Maine has state preemption preventing municipalities from enacting firearms regulations more restrictive than state law (Title 25 § 2011). However, municipalities retain some authority to regulate the discharge of firearms within their boundaries. Sales and transfer regulations are uniform statewide.

Cross-Border Considerations

Maine borders New Hampshire (similarly permissive) and Massachusetts (significantly more restrictive). If you sell to out-of-state buyers, remember that long gun sales to non-residents are permissible if the sale complies with both Maine law and the buyer's home state law. Handgun sales to non-residents must go through an FFL in the buyer's state.

Be particularly cautious with buyers from Massachusetts — magazines exceeding 10 rounds, certain semi-automatic firearms, and other items legal in Maine may be prohibited in Massachusetts. Selling legal items to a buyer who intends to illegally transport them across state lines creates potential liability.
