Background Checks & CWP Exemption
Montana is a NICS direct-contact state. The three-business-day default proceed applies. Montana's CWP qualifies as a NICS alternative — buyers presenting a valid, unexpired Montana CWP may purchase without a NICS check. The 4473 must still be completed in full.
State Preemption
Montana Code § 45-8-351 provides state preemption, preventing local governments from enacting firearms regulations more restrictive than state law. This ensures uniform compliance requirements statewide, though municipalities retain authority to regulate the discharge of firearms within city limits.
Private Transfers
Montana does not require background checks for private transfers. Private sales between Montana residents may be conducted without dealer involvement.
Recordkeeping
Montana imposes no state-specific recordkeeping requirements for firearms dealers. Federal standards apply exclusively. When buyers present Montana CWPs, record the permit number and expiration on the 4473.
