NICS Background Check Delays: What Dealers Need to Know

How the NICS System Works

The National Instant Criminal Background Check System is operated by the FBI and processes background check requests from FFLs before firearms transfers. When you submit a check, NICS queries multiple databases including the National Crime Information Center (NCIC), the Interstate Identification Index (III), and the NICS Index.

The system returns one of three responses: Proceed (the transfer may go forward), Delayed (more research is needed), or Denied (the transfer is prohibited). Understanding each response — and your obligations for each — is fundamental to your daily operations.

Proceed Responses

A "Proceed" response means the FBI has found no disqualifying records and the transfer may be completed. Record the NICS Transaction Number (NTN) and the date on the 4473. The proceed response is valid for 30 calendar days from the date of the check — if the transfer isn't completed within that window, a new background check is required.

Delayed Responses and the Brady Transfer Date

A "Delayed" response means NICS needs additional time to research potential matching records. This happens more often than dealers expect — common triggers include common names, prior arrests that were resolved favorably, incomplete court dispositions, and records that need verification from other agencies.

If NICS does not provide a final determination within three business days, federal law allows you to proceed with the transfer at your discretion. This is the "Brady Transfer Date." However, proceeding on a Brady date carries risk — if the check ultimately comes back denied, you've transferred a firearm to a prohibited person. The ATF will contact you to retrieve the firearm.

Some states override the federal three-day default with longer mandatory waiting periods. Know your state's rules before relying on a Brady transfer.

Denied Responses

A "Denied" response means the person is prohibited from receiving a firearm under federal or state law. Do not complete the transfer under any circumstances. Record the denial on the 4473 and retain the form. The customer has the right to appeal the denial through the FBI's NICS Appeals Services.

Do not inform the customer of the specific reason for the denial — you likely don't know it, and speculating creates liability. Simply inform them that the background check was denied and provide them with the NICS appeal information.

Communicating with Customers During Delays

Delays are frustrating for customers — especially repeat buyers who've been approved instantly in the past. Set expectations upfront: explain that delays are common, not personal, and usually resolve within a few days. Provide a timeline ("We'll contact you as soon as we hear back") and follow through.

State-Specific Variations

States handle background checks differently. Some are "full point of contact" states where the state police conduct all checks. Others are "partial point of contact" where the state handles handguns and the FBI handles long guns. And many states use the federal NICS system directly.

Additionally, some states impose waiting periods that override the federal Brady transfer date. California, Florida, Hawaii, and others have their own waiting period requirements. Always default to the more restrictive requirement — whether that's state or federal.
