Maryland Firearms Regulatory Overview
Maryland has one of the most comprehensive state firearms regulatory frameworks in the country. The state requires a Handgun Qualification License (HQL) for all handgun purchases, operates its own background check system through the Maryland State Police (MSP), bans assault weapons, limits magazine capacity to 10 rounds, imposes a 7-day waiting period, and requires state-specific dealer licensing. For dealers, Maryland demands rigorous dual-track compliance.
Handgun Qualification License (HQL)
Any person purchasing a handgun in Maryland must hold a valid Handgun Qualification License issued by MSP. The HQL requires completion of a firearms safety training course (minimum 4 hours, including live-fire training), a background check and fingerprinting at the time of application, and is valid for 10 years. As a dealer, you must verify the buyer's HQL before completing any handgun sale.
The HQL does not apply to long gun purchases — only handguns. Rifles and shotguns (that don't meet the assault weapons definition) may be purchased without an HQL, though the background check and waiting period still apply.
Exemptions from the HQL requirement include active and retired law enforcement officers, active military, and holders of valid Maryland Wear and Carry permits. Verify the exemption documentation carefully.
Maryland State Police Background Checks
Maryland is a point-of-contact state — all background checks are processed through the Maryland State Police Licensing Division, not directly through NICS. MSP queries the federal NICS database plus Maryland-specific records including state criminal history, mental health records, and protective orders.
Maryland does not follow the federal three-day default proceed. You must wait for explicit MSP approval before completing the transfer. Combined with the mandatory 7-day waiting period, this means Maryland transactions are among the slowest in the country. Plan your customer communication accordingly.
7-Day Waiting Period
Maryland imposes a mandatory 7-day waiting period for all regulated firearm purchases (handguns and assault-weapon-type long guns). The waiting period begins when the application is submitted to MSP and must expire before the firearm is released, regardless of when MSP returns an approval.
The waiting period does not apply to certain long guns (non-regulated rifles and shotguns), but the MSP background check is still required. Track waiting periods and background check statuses for every transaction to prevent premature releases.
Assault Weapons Ban & Magazine Limits
Maryland's Firearms Safety Act of 2013 bans assault weapons (named firearms and feature-based criteria) and limits magazine capacity to 10 rounds. You cannot sell any firearm or magazine that falls within the prohibited definitions. Review the statutory definitions carefully — Maryland's feature-based test covers semi-automatic rifles, pistols, and shotguns with specific characteristics.
State Dealer Licensing
Maryland requires firearms dealers to hold a state Regulated Firearms Dealer License in addition to the federal FFL. The state license involves additional requirements including a place of business open to the public, specific security requirements, and compliance with state inspection protocols. Maintain both your federal and state licenses and ensure both are current.
Maryland Recordkeeping
Maryland requires dealers to maintain state-specific transaction records and submit sales data to MSP. In addition to your federal A&D bound book and 4473s, maintain records of HQL verification, MSP approval numbers, waiting period tracking, and state dealer reports. Keep state and federal records integrated so you can respond efficiently to inspections from either the ATF or MSP.
