North Dakota enacted permitless carry for residents in 2017 (HB 1169). Non-residents still need a permit. The state has strong preemption, no waiting period, no assault weapons restrictions, and no magazine limits. North Dakota's Class 1 Concealed Weapons License (CWL) qualifies as a NICS alternative.
Background Checks & CWL Exemption
North Dakota is a NICS direct-contact state. The three-business-day default proceed applies. North Dakota's Class 1 CWL qualifies as a NICS alternative. The Class 2 CWL does not. Verify the license class before waiving the NICS check. The 4473 must still be completed.
State Preemption
North Dakota Century Code § 62.1-01-03 provides state preemption. Political subdivisions cannot enact ordinances relating to the purchase, sale, ownership, possession, transfer, or transportation of firearms more restrictively than state law.
Private Transfers
North Dakota does not require background checks for private transfers. Private sales between residents may be conducted without dealer involvement.
Recordkeeping
North Dakota imposes no state-specific recordkeeping requirements for firearms dealers. Federal standards apply exclusively.
