While Nevada remains more permissive than coastal states, FFLs need to understand where state law adds requirements beyond the federal baseline — especially in Clark County.

Nevada FFL Licensing State Laws Compliance

Universal Background Check Law

Nevada's Question 1, as amended by AB 62 (2019), requires background checks for most private party firearms transfers. As an FFL, this directly impacts your business — private parties who want to transfer firearms legally now need to come to a licensed dealer to facilitate the background check.

You should establish a clear process and fee structure for facilitating private party transfers. This is both a compliance obligation and a business opportunity — every facilitated transfer is a customer walking through your door who might not have otherwise.

Nevada's Background Check Process

Nevada uses the FBI's NICS system for background checks rather than maintaining a state point of contact. However, Nevada law adds its own prohibited person categories beyond the federal list. The state's Department of Public Safety (DPS) may also become involved in certain flagged transactions.

The standard NICS process applies: contact NICS, receive a proceed/delay/deny response, and document the NTN on the 4473. Nevada does not impose a state waiting period beyond the federal NICS process.

Clark County Specific Ordinances

While Nevada has state preemption (NRS 244.364 and 268.418), Clark County has historically been the most active jurisdiction in the state regarding firearms regulations. Clark County's ordinances include requirements around dealer licensing, business registration with the Metropolitan Police Department, and specific operating conditions for firearms businesses.

If you operate in the Las Vegas metropolitan area, verify your compliance with both state requirements and Clark County/Las Vegas municipal ordinances. Requirements for business permits, location restrictions, and operating hours may differ from the rest of the state.

Nevada Pawn and Firearms

Nevada has a thriving pawn industry, particularly in Las Vegas and Reno. Pawn shops that accept firearms must hold an FFL and comply with both Nevada's pawn statutes and federal firearms regulations. Nevada's pawn hold periods, reporting requirements, and customer identification rules apply alongside your ATF compliance obligations.

Firearms pawned and not redeemed become part of your inventory and must be processed through your bound book accordingly. The disposition of forfeited firearms follows the same ATF requirements as any other sale — including a 4473 and NICS check for the new buyer.
