Mississippi FFL Compliance Guide: Permitless Carry, Enhanced Permits & NICS Exemptions

Mississippi has permitless carry and an enhanced carry permit that's NICS-exempt. State requirements are minimal — federal compliance is your focus. Here's what Mississippi dealers need to know.

Mississippi Firearms Regulatory Overview

Mississippi is one of the most firearms-friendly states. Permitless carry has been in effect since 2016 (for concealed carry without a permit in a holster, sheath, or case — and expanded further since). The state has strong preemption, no waiting period, no state permits to purchase, no assault weapons restrictions, and no magazine limits. Mississippi offers an Enhanced Carry Permit that qualifies as a NICS alternative.

Background Checks & NICS Exemption

Mississippi is a NICS direct-contact state. The three-business-day default proceed applies. Mississippi's Enhanced Carry Permit qualifies as a NICS alternative — buyers presenting a valid, unexpired Enhanced Carry Permit may purchase without a NICS check. The standard carry permit does not qualify. Verify the permit type before waiving the check. The 4473 must still be completed.

State Preemption

Mississippi Code § 45-9-51 provides broad state preemption. No county, municipality, or other governmental subdivision may adopt any ordinance that restricts the possession, carrying, transportation, sale, transfer, or ownership of firearms more restrictively than state law.

Private Transfers

Mississippi does not require background checks for private transfers. No dealer involvement is required for private sales between Mississippi residents.

Pawn Regulations

Mississippi regulates pawnbrokers under state law with licensing and reporting requirements. For firearms pawns, maintain compliance with both state pawn statutes and federal ATF requirements. Track holding periods for forfeited items per state law before placing them for sale.
