Louisiana FFL Compliance Guide: Permitless Carry, CHP Exemptions & Pawn Compliance

Louisiana enacted permitless carry in 2024, has a CHP that's NICS-exempt, and has a significant pawn industry with firearms-specific requirements. Here's the compliance picture for Louisiana dealers.

Louisiana Firearms Regulatory Overview

Louisiana enacted permitless carry (constitutional carry) effective July 4, 2024, allowing individuals 18 and older who are legally permitted to possess firearms to carry concealed without a permit. The state has strong preemption, no waiting period, no assault weapons restrictions, and no magazine limits. Louisiana's Concealed Handgun Permit (CHP) remains available and qualifies as a NICS alternative.

Background Checks & CHP Exemption

Louisiana is a NICS direct-contact state. Standard federal procedures apply with the three-business-day default proceed. Louisiana's CHP qualifies as a NICS alternative — buyers with a valid, unexpired Louisiana CHP may purchase without a NICS check. Complete the 4473 in full regardless.

The CHP remains popular in Louisiana for NICS exemption benefits, out-of-state reciprocity, and the efficiency it provides at the counter. Many of your regular customers will hold active CHPs.

State Preemption

Louisiana Revised Statutes § 40:1796 provides strong state preemption. No local governmental subdivision may enact ordinances or regulations pertaining to firearms that are more restrictive than state law. Compliance requirements are uniform statewide.

Pawn Industry Compliance

Louisiana has a significant pawn industry, and firearms represent a major category for pawnbrokers. Louisiana's pawn statutes require licensing, transaction reporting to local law enforcement, and minimum holding periods for pledged items. For firearms pawns, you must maintain compliance with both state pawn regulations and federal ATF requirements.

Louisiana pawnbrokers must report pawn transactions to law enforcement, typically through an electronic reporting system. Firearms pawns create entries in both your state reporting system and your federal A&D bound book. Ensure these records are consistent — discrepancies between state reports and federal records will draw attention from both regulators.

Holding periods for pawned items in Louisiana are set by statute and local ordinance. Verify the specific holding period in your jurisdiction before selling forfeited firearms. Some parishes may impose longer holding periods than the state minimum.

Private Transfers

Louisiana does not require background checks for private party transfers. Private sales between Louisiana residents may be conducted without dealer involvement.

Recordkeeping

Louisiana does not impose additional state-level recordkeeping requirements for firearms dealers beyond state pawn reporting obligations. Federal standards govern your firearms compliance records. For pawnbrokers, maintain both your state pawn transaction reports and your federal A&D bound book with consistent, accurate entries.
