Kansas FFL Compliance Guide: Constitutional Carry, NICS Exemptions & State Preemption

Kansas has constitutional carry, a concealed carry license that's NICS-exempt, and a Second Amendment Protection Act. But federal law still applies to every sale, here's what Kansas dealers need to know.

Kansas Firearms Regulatory Overview

Kansas has been a constitutional carry state since 2015. The state has strong preemption, no waiting period, no state permits required to purchase, no assault weapons restrictions, and no magazine capacity limits. Kansas also enacted the Second Amendment Protection Act (SAPA), though its practical impact is limited by federal supremacy.

Background Checks & NICS Exemption

Kansas is a NICS direct-contact state. The standard three-business-day default proceed applies. Kansas's Concealed Carry Handgun License (CCHL) qualifies as a NICS alternative. Buyers with a valid, unexpired Kansas CCHL may purchase without a NICS check. The 4473 must still be completed.

Verify the license carefully, it must be a Kansas-issued CCHL, valid and unexpired. Out-of-state permits do not qualify.

Second Amendment Protection Act

Kansas's SAPA declares that firearms manufactured and remaining within Kansas are not subject to federal regulation. However, the ATF has made clear that federal law applies to all firearms transactions conducted by FFLs, regardless of state legislation. As an FFL, you must comply with all federal requirements, SAPA does not exempt you from the 4473, NICS, or any other ATF obligation. Do not rely on SAPA as a basis for bypassing federal compliance.

State Preemption

Kansas has comprehensive state preemption (K.S.A. 12-16,124). Local governments cannot regulate firearms more restrictively than state law. This provides uniform compliance requirements across the state.

Private Transfers

Kansas does not require background checks for private transfers. Private sales between Kansas residents may be conducted without dealer involvement.

Kansas imposes no state-specific recordkeeping requirements for firearms dealers. Federal standards govern your entire compliance framework. Focus on ATF requirements: accurate A&D book entries, complete 4473s, timely 3310.4 filings, and audit-ready records.
