Nebraska Firearms Regulatory Overview
Nebraska enacted permitless carry (LB 77) in 2023, simultaneously repealing the state's longstanding handgun purchase certificate requirement. This significantly simplified the purchase process — buyers no longer need a sheriff-issued certificate to purchase handguns. The state has preemption, no waiting period, no assault weapons restrictions, and no magazine limits.
Background Checks & CHP Exemption
Nebraska is a NICS direct-contact state. The three-business-day default proceed applies. Nebraska's Concealed Handgun Permit (CHP) qualifies as a NICS alternative. Buyers with a valid CHP may purchase without a NICS check. Without a CHP, standard NICS procedures apply for all sales. The 4473 is always required.
Handgun Certificate Repeal
Prior to 2023, Nebraska required a Handgun Purchase Certificate issued by the county sheriff for all handgun acquisitions (including private sales). This certificate has been repealed. Handgun purchases now follow the same process as long gun purchases — 4473 and NICS check (or NICS-exempt CHP). No additional state permit or certificate is required.
State Preemption
Nebraska has state preemption preventing cities and counties from regulating firearms more restrictively than state law, with limited exceptions for regulating the discharge of firearms within municipal boundaries.
Private Transfers
With the repeal of the handgun purchase certificate, private handgun transfers no longer require any state documentation. Private sales between Nebraska residents may be conducted without dealer involvement or background checks.
