Zoning and HOA rules are the number one reason home-based FFL applications fail. Use these ready-to-send letters to get a clear, written yes from your city, your HOA, and your landlord before you apply.

Home-based FFL Zoning & HOA Copy, fill, send

On the ATF application you certify that running the business from your address does not violate local law. Get that confirmed in writing first. Copy each letter below, replace the highlighted fields, and keep every reply for your records.

How to use this template

Three steps
  1. Identify who controls the answer: your municipal zoning or planning office, your HOA board, and your landlord if you rent.
  2. Send the matching letter below. Ask for a written reply, not a phone answer you cannot document.
  3. File every response with your application paperwork. A written approval is your best protection if the answer is ever questioned.

Letter 1: City zoning or planning office

To: [City/County] Zoning or Planning Department Date: [Date] Re: Home occupation zoning verification for [your street address] To whom it may concern, I am requesting written verification of the zoning rules that apply to operating a low-traffic, home-based federal firearms dealer business at the residential address above. I intend to apply for a federal firearms license (ATF Form 7) and want to confirm that a home occupation of this type is permitted under current local ordinances. The business would involve receiving and transferring firearms, with records and inventory stored securely on the premises. It would not involve significant walk-in retail traffic, exterior signage, or changes to the residential character of the property unless you advise that any are required or permitted. Please confirm in writing: 1. Whether a home-based firearms business is permitted at this address under current zoning. 2. Whether a home occupation permit, conditional use permit, or variance is required. 3. Any conditions, restrictions, or limits that would apply. Letter 2: Homeowners association board

To: [HOA name] Board of Directors Date: [Date] Re: Request to operate a home-based business at [your address] Dear Board, I am writing to request written confirmation that operating a quiet, low-traffic home-based business at my residence is permitted under our community covenants. I plan to apply for a federal firearms license and operate as a home-based dealer, primarily handling online orders, transfers, and secure record-keeping. The activity would not generate meaningful visitor traffic, noise, exterior signage, or any change to the appearance of the property. Could you please confirm in writing whether the covenants permit a home occupation of this kind, and note any conditions that would apply? Letter 3: Landlord permission (if you rent)

The business is a federally licensed firearms operation focused on online orders, transfers, and secure record-keeping. It would not involve significant visitor traffic, alterations to the unit, or anything that changes the residential use of the property. The ATF requires that my business comply with local law and any lease terms, so a written acknowledgment from you that this use is permitted under our lease would let me proceed with my application. Get this in writing before you apply

Documentation checklist
  • Written zoning verification or home occupation permit from the city or county.
  • Written HOA approval, or confirmation that no HOA applies.
  • Written landlord permission if you rent.
  • Copies of the ordinances or covenant sections you relied on.
  • A dated file with every reply, kept alongside your application.
If the answer is no: ask whether a conditional use permit or variance is available, whether limiting hours or traffic would change the answer, or whether a different room or address on the property qualifies. A denial on one configuration is not always a denial on every configuration.
